Hello, and welcome to OPDC's home for the Planning Obligations Supplementary Planning Document (SPD) Consultation that took place between 27 September 2022 to midnight 8 November 2022. The consultation has now closed. OPDC's Board approved the adoption of the SPD on 15 June 2023.


Purpose of the Planning Obligations SPD

The Planning Obligations SPD (POSPD) provides guidance on the planning obligations which OPDC will secure through Section 106 agreements, which are legal agreements between the local planning authority (in this case OPDC) and a developer, setting out the terms for planning obligations, including how much money is being paid, when and on what. Planning obligations are secured to mitigate the impact of development and ensure that it is acceptable in planning terms. Planning obligations are usually financial contributions from a developer which are then spent by the local planning authority or other service provider on infrastructure such as roads, schools, public transport, open space, or securing the provision of affordable housing.

In making clear OPDC’s requirements, the document will provide stakeholders with more certainty when assessing the development potential of land earlier on in the development process. In doing so, this should speed up negotiations, and help OPDC secure a greater range of provisions toward the implementation of the adopted OPDC Local Plan.

Now adopted, the document will be a material consideration in the determination of planning applications. OPDC will work with applicants early on in the application process seeking compliance with the SPD to ensure acceptable developments.
